Papa Murphy’s Advertising Text Message Class Action Settlement

Papa Murphy’s has agreed to pay $22.6 million to resolve allegations that the take-and-bake pizza company violated federal law by sending unwanted text messages to potential customers.

If you received an advertising text from Papa Murphy’s between Oct. 16, 2013 and June 15, 2015, you could get $10 in cash and $10 in online order vouchers from this class action settlement.

Plaintiff John Lennartson filed the Papa Murphy’s class action lawsuit in 2015 after allegedly receiving a text that read “Papa Murphy’s: Today only 4/6/15. A Big Deal for the Big Game! Get a $10 Lg 5-Meat Stuffed Pizza. Valid @ participating Stores. Msg & Data Rates May Apply. STOP to end.”

Lennartson said the unwanted advertising text message was sent in violation of the Telephone Consumer Protection Act because it was transmitted to his cell phone without his express consent.

The Papa Murphy’s TCPA class action lawsuit was fought repeatedly by the pizza chain before the parties eventually used a mediator to reach the current settlement.

According to the Papa Murphy’s class action settlement , the company will pay $11.3 million in cash and provide as much as $11.3 million in Papa Murphy’s vouchers to resolve the allegations. Class Members who file a valid and timely claim will receive $10 in cash as well as two $5 online order vouchers.

“The settlement here is the product of good-faith bargaining at arm’s-length and was negotiated over many months and through a formal mediation conducted by a well respected mediator,” the plaintiffs said in their motion for preliminary approval of the Papa Murphy’s class action settlement. “Thus, the settlement here is the product of hard-fought adversarial negotiations between the parties.”

Class Members who want to object to the terms of the Papa Murphy’s TCPA class action settlement or want to opt out of it, must do so no later than Aug. 14, 2018.

Who’s Eligible

Class Members include all U.S. residents who received an advertising text message from Papa Murphy’s between Oct. 16, 2013 and June 15, 2015.

Potential Award

$10 in cash and $10 in Papa Murphy’s vouchers.

Proof of Purchase

When submitting a claim, consumers are asked to provide the phone number that received the text message from Papa Murphy’s.

    Papa John’s sued for $250 million in text message class action

    Plaintiffs filed a class action lawsuit against Papa John’s , arguing that a text message campaign conducted by the company’s franchises violated the Telephone Consumer Protection Act. According to the complaint, the franchisees sent text messages to customers without their consent, in violation of the TCPA. Under the law, a plaintiff can recover between $500 to $1,500 for each message sent without consent, depending on whether the violation is willful.

    As we’ve noted in previous posts, the number of lawsuits involving text message campaigns has increased dramatically in recent years. Part of the increase is because many companies aren’t paying attention to legal requirements. But the increase is also largely because class action attorneys have come to see these cases as an easy way to make money. For example, a recent case involving text messages sent by Jiffy Lube settled for $47 million. These attorneys will seize on any violation — no matter how minor — as an opportunity to force a settlement.

    Most of the recent lawsuits could have been avoided if the text message campaigns if the campaigns had been carefully reviewed prior to launch. Sometimes, there’s a tendency to try to skip that step in order to cut costs and launch quickly, but the recent string of multi-million dollar settlements demonstrates that’s a very short-sighted approach. It will cost exponentially less time and money to do things right from the start. If you’re planning a new campaign, get your legal team involved early in the process.

    Papa John’s has clearly been a little over-eager with its digital promotion. Now, it’s facing a $250 million class-action lawsuit over all the spammy text messages it’s been sending you and everybody else around the US.

    It’s alleged that Papa John’s sent 500,000 unwanted messages in early 2010, CNN Money reports . It gets worse: at times, customers were receiving 15 texts in a row, even in the middle of the night. Nobody needs a pizza offer that badly.

    Of course, those texts were actually sent through a third-party text messaging service—in this case one called OnTime4U—so both companies will find themselves in the dock. And it could prove costly: the plaintiffs in the case are seeking damages of $500 per text. Think of all the pizza you could buy with that. [ CNN Money]
